Definition

Lot consolidation: A lot consolidation is the combining of two (2) or more parcels, where a greater number of parcels than originally existed is not thereby created.

Preliminary Review

It is highly recommended that prior to the submission of an Application for a Lot consolidation, with the Engineering Department, that the party considering the consolidation meets with representatives from the City’s Community Development Department to do a preliminary review of the proposed consolidation to ensure that the properties affected will meet Planning and Zoning ordinances in the after state.

Applications and Review

An application for lot consolidations can be obtained at the City’s Public Works Department Engineering Division or at the bottom of this page.There is a one time application fee due at the time of application submission; please contact the Public Works Department Engineering Division at 714-738-6845 for the current fee.The application shall include, but is not limited to; the legal description of the lots or parcels to be consolidated, the owner's names, addresses, and telephone numbers, evidence of title and such other information as may be required. A map sketch showing the lots or parcels before and after the consolidation, their relationship to each other, adjoining lots or parcels, street centerlines or right-of-way lines, existing buildings, fences, etc., and the latest Orange County Assessor parcel numbers shall also be reflected on the documentation.The legal description and map sketch must be prepared by a Registered Civil Engineer or Licensed Land Surveyor of the State of California.The complete application, legal descriptions and map sketch shall be submitted to the City’s Real Property Agent (“RPA”).Once your application package is received, the RPA will route the package to other City departments for review and comment and to the City’s Surveyor, for review and preliminary approval.

Final Approval and Recordation

Once the RPA receives the approved Lot Consolidation from the City Surveyor, the Consolidation package is then routed to the Directors of the Community Development and Engineering Departments for final approval.Upon final approval the fully executed original Lot Consolidation package is sent to the preparer to coordinate recordation of the documents.Once the Lot Consolidation is recorded the original recorded Lot Consolidation is to be returned to the City.

Note:The duration for processing lot consolidations vary on a case by case basis, but city staff will work with you to get your lot consolidation processed in the timeliest manner possible.

Lot Consolidations

16.04.040 Lot consolidations

The Director of Development Services may approve or disapprove an application for a lot consolidation, and his determination as to whether a division may be classed as a lot consolidation shall be final. His action shall be in writing and sent by mail to the applicant within fifty days of filing.

A. Application. An application shall be submitted in writing, in a form provided by the City Engineer which shall give the legal description of the lots or parcels to be adjusted, the owner's names, addresses, and telephone numbers, evidence of title and such other information as may be required. A map sketch, in a form provided by the City Engineer, showing the lots or parcels before and after their adjustment, their relationship to each other, adjoining lots or parcels, street centerlines or right-of-way lines, existing buildings, fences, etc., and the latest Orange County Assessor parcel numbers shall also be submitted. The complete application and map sketch shall be submitted to the Director of Development Services for his approval as to zoning and building ordinances prior to submittal to the City Engineer for his review as to correctness and sufficiency.

B. Appeal From Action by the Director of Development Services. If the applicant for a lot consolidation wishes to appeal the decision of the Director of Development Services or the requirements and conditions pertaining to his approval or denial of the lot consolidation, he shall file a written appeal with the Director of Development Services within fifteen days of the Director of Development Services' written action. The application, along with a staff report setting forth the requirements and other information regarding the lot consolidation, shall then be sent to the Planning Commission, who shall hear the appeal. A copy of the report shall also be sent to the owner or applicant making the appeal at least three days prior to any hearing or action by the Planning Commission. Upon receipt of the report, the Planning Commission shall review the matter at its first regular meeting held, but not less than ten days after its receipt. The decision of the Planning Commission approving, conditionally approving or denying the appealed lot consolidation or conditions thereof shall be final unless a further appeal to the City Council is made within ten days after action by the Planning Commission. If a further appeal is made, it shall be handled in the same manner as outlined above for regular division by parcel map. (Ord. 2722 (part), 1990).

16.04.050 Consolidation -- Determination of applicability.

The City Engineer shall have the authority, based upon the evidence and data available and presented to him, to determine when any proposed consolidation of lots shall be construed as a reversion to acreage, as described in Section 16.04.020 or as a lot consolidation, as described in Section 16.04.030. In the absence of any appeal to the Planning Commission or City Council, his decision shall be final and thereafter, the consolidation or reversion of lots or parcels shall be processed in accordance with the applicable section of this chapter.
