In accordance with the requirements of Title II of the Americans with Disabilities Act of 1990 (ADA), and ADA Amendments Act of 2008, the City of Fullerton does not discriminate against qualified individuals with disabilities on the basis of disability in its services, programs, or activities.
The City of Fullerton under Title VI of the Civil Rights Act of 1964 as amended in 1972, 1978, and 1992, shall not, on the ground of race, color, or national origin, exclude any person from participation in, deny any person the benefits of, or subject any person to discrimination under any program or activity receiving Federal financial assistance.
Purpose
The City of Fullerton is committed to ensuring that people with disabilities are able to take part in, and benefit from, the whole range of public programs, services, and activities offered by the City. Further, the City is committed to ensuring that people served shall not be denied the benefits of, or be subjected to discriminate on the basis of race, color, sex, age, disability, or national origin. The City continues to modify its facilities, programs, policies, or practices, as necessary to ensure such access is provided.
Title II of the Americans with Disabilities Act and Title VI of the Civil Rights Act of 1964 requires that public entities adopt and publish grievance procedures to assure the prompt and equitable resolution of complaints. The purpose of the grievance procedure is to resolve as promptly as possible any problems, complaints, or conflicts related to the city's compliance without the need for the complainant to resort to other remedies available under the law.
Filing An Americans With Disabilities Act Grievance
This Grievance Procedure is established to meet the requirements of the Americans with Disabilities Act of 1990 ("ADA"). It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits by the City. The City's Personnel Policy governs employment-related complaints of disability discrimination.
The complaint should be in writing and contain information about the alleged discrimination such as name, address, phone number of complainant and location, date, and description of the problem. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint, will be made available for persons with disabilities upon request.
The complaint should be submitted by the grievant and/or his/her designee as soon as possible but no later than 60 calendar days after the alleged violation to:
